As a general legal principle, Kaskade, as a content provider, is responsible for the content it furnishes. A distinction must be made between Kaskade's own contents and links to the contents of other providers. We furnish foreign content to the extent that is identified as a link. We may only be held responsible for this foreign content if we are aware that such content is illegal or felonious and if it is technically feasible to prevent the use thereof and if we can reasonably be expected to do so. Links, however, are living dynamic references. We check the link when it is first established so as to verify that it does not constitute a civil or criminal violation. However, we are not obligated to continually monitor contents for changes that might give rise to renewed liability. Only if it has been determined, or if others have indicated, that a concrete offer contained in a link may give rise to a civil or criminal violation, will we suspend the link to the extent that this is technically feasible and we can reasonably be expected to do so. The fact that it may continue to be possible to access the illegal or felonious offer from other servers shall have no influence on the technical feasibility and the reasonability test even after Kaskade has blocked access to the site in question.
